Removal of conditions is a legal process that allows a person married to a citizen
American to change their status from conditional permanent resident to permanent resident. This is done at
through the United States Citizenship and Immigration Services (USCIS).


When a person obtains residency (Green Card) through marriage, they first receive a conditional card valid for 2 years. Before it expires, you must request the removal of conditions to obtain a Green Card valid for 10 years.

What does it mean to have conditional permanent residence? It means that you can live and work in the United States like any other resident, but only for 2 years.

Afterwards, you must update your status and request a Green
Card for 10 years. The conditional Green Card cannot be renewed.

You must adjust your immigration status 90 days before your provisional card expires. If you don't, you will lose your residency. It is necessary to demonstrate that you
Marriage was not only to obtain immigration benefits.

How do I request the removal of conditions? If you or your spouse have conditional residency, you must file Form I-751 to obtain a permanent Green Card.

Here are some tips:
• File the I-751 within 90 days before your conditional residency ends. If you do it too early or late, it may be returned or denied.
• The I-751 must be completed and signed by both spouses.
• Include proof that your marriage is real, such as photos together, financial documents, and, if any, children.
• Attach a copy of both sides of your conditional Green Card and pay the corresponding fees
(Check current rates on the USCIS website.

Prior to April 7, 2022, an interview with USCIS was required.

Now if the evidence is
enough, the interview may not be necessary.

Consequences of not requesting the removal of conditions If you do not do so, you will be “out of status” and could face deportation or a ban on entry into the United States for 3 or 10 years.
